Welcome to Seablue Inc operating as Sea Blue Fish. These Terms & Conditions (“Terms”) govern your use of our website and your purchase of products from Seablue Inc operating as Sea Blue Fish (“Seablue Inc,” “Sea Blue Fish,” “we,” “us,” or “our”). By browsing this site, placing an order, or accepting delivery or pickup of our products, you agree to be bound by these Terms. Please read them carefully. If you do not agree, please do not use the site or place an order.

1. Who We Are

Sea Blue Fish is a kosher fish market serving the Brooklyn, New York community and surrounding areas.

2. Kashrus & Supervision

All products sold by Sea Blue Fish are prepared and sold under the strict kosher supervision of CRC – Hisachdus HaRabbonim. Kosher status applies to products in their original, unopened condition as supplied by us. We are not responsible for the kosher status of products after they have been opened, combined with other foods, cooked, or otherwise handled outside of our facility.

3. Terms Acceptance

Acceptance of These Terms – You accept these Terms by checking the acceptance box presented at checkout before you place your order. We record the date and time of your acceptance, and the version of these Terms in effect at that moment, with your order.
Orders & Order Acceptance – Placing an order constitutes an offer to purchase. All orders are subject to acceptance and availability. We reserve the right to accept, decline, or limit any order, in whole or in part, at our discretion. Your order is confirmed only when we accept it; a website order confirmation acknowledges receipt but does not by itself guarantee acceptance or availability. Items marked “Preorder,” “Check Availability,” or similar are subject to confirmation before they are fulfilled.

4. Pricing & Products Sold by Weight

Prices are shown in U.S. dollars and are subject to change without notice. Many of our items are fresh fish sold by weight (per lb.). For these items, the price shown is based on an estimated or standard weight, and the final charge may vary slightly based on the actual weight of the fish selected and cut for your order. By ordering a by-weight item, you authorize a final charge based on the actual weight, which may be modestly higher or lower than the amount shown at checkout. We make every effort to display accurate pricing and product information, but we are not responsible for typographical errors, and we reserve the right to correct any errors and to cancel any order placed for a product listed at an incorrect price.

For items sold by weight, your card is authorized at the estimated amount shown at checkout, and the final charge is based on the actual weight of the fish cut for your order. The final charge for any by-weight item will not exceed 15% above the estimated amount shown at checkout for that item. If the actual weight would produce a charge above that limit, we will contact you for approval before charging, or adjust the quantity so that the charge stays within it. Where the actual weight is lower than estimated, you are charged the lower amount.

5. Payment

Payments are processed securely through our payment processor also known as Sola. We accept major credit and debit cards as shown at checkout. By submitting payment information, you represent that you are authorized to use the payment method and you authorize us (and our payment processor) to charge the full order amount, including any applicable taxes, delivery fees, and any weight-based adjustment for by-weight items. We do not store full card numbers on our servers.

6. Pickup & Delivery

We offer free store pickup as well as local and area delivery.

Order cut-off times. Orders for a given delivery or pickup date must be placed by the posted weekly cut-off time. Orders placed after the cut-off will be scheduled for the next available date. Delivery windows and cut-off times are posted on the site and may change around Yamim Tovim and holidays.

We are not responsible for delays caused by weather, traffic, incorrect or incomplete address information, the recipient being unavailable, or other circumstances beyond our reasonable control. It is your responsibility to provide accurate delivery details and to ensure that someone is available to receive perishable products promptly.

7. Perishable Products & Food Safety

Our products are fresh, perishable foods. Once a delivery is completed or an order is picked up, proper refrigeration and handling are your responsibility. Perishable products left unattended or not promptly refrigerated may spoil, and we are not liable for spoilage resulting from improper storage or handling after the order leaves our care.

8. Cancellations, Changes & Refunds

Because our products are freshly cut and highly perishable, orders generally cannot be changed or cancelled after we start processing it. If you need to change or cancel an order, please contact us as soon as possible at seablue519@gmail.com or at (718) 643-9600 and we will do our best to accommodate you before we start processing it.

Quality concerns. Your satisfaction matters to us. If there is a problem with the quality or accuracy of your order, please contact us within 24 hours of pickup or delivery, with your order details and, where possible, a photo. We will review each situation and work with you to reach a suitable remedy, which may include a replacement, store credit, or refund. Refunds, where granted, are issued to the original payment method. We do not accept returns of perishable food products for reasons of change of mind.

9. Product Availability & Substitutions

All products are subject to availability. Fresh fish supply varies. If an item you ordered is unavailable, we may contact you to offer a substitution, adjust your order, or refund the affected item.

10. Allergens

Our products are fish and seafood and are handled in a facility that processes fish, wheat, nuts, soy, and eggs. If you have allergies or dietary restrictions, please contact us before ordering. You are responsible for reviewing product information for your own dietary needs.

11. Images & Content

Product images and platter photographs on this site are for illustration purposes only, and actual products may vary in appearance, size, and presentation. All content on this site, including text, graphics, logos, and images, is the property of Sea Blue Fish or its licensors and may not be copied or used without permission.

12. Promotions & Coupons

Any discounts, coupons, or promotions are subject to their stated terms, cannot be combined unless expressly permitted, have no cash value, and may be modified or discontinued at any time.

13. Limitation of Liability

To the fullest extent permitted by law, Seablue Inc operating known as Sea Blue Fish’s total liability for any claim arising out of or relating to a product or order is limited to the amount you paid for that order, and we are not liable for any indirect, incidental, or consequential damages.

Exceptions. This limitation does not apply to, and nothing in these Terms limits, our liability for personal injury or death, for fraud or fraudulent misrepresentation, or for gross negligence or willful misconduct.

New York residents. The limitation of liability in this Section 13 does not apply to claims for personal injury arising from the products we sell. Nothing in these Terms waives, limits, or otherwise affects any right you have under the New York Consumer Fraud Act, N.J.S.A. 56:8-1 et seq., or the New York Truth-in-Consumer Contract, Warranty and Notice Act, N.J.S.A. 56:12-14 et seq., and any provision of these Terms that would do so is void and unenforceable in New York.

14. Privacy

Information you provide when ordering (such as your name, contact details, and delivery address) is used to process and deliver your order and to communicate with you about it. We do not sell your personal information. Payment card details are handled securely by our payment processor. It’s all governed by our Privacy Policy

15. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in New York.

16. Changes to These Terms

We may update these Terms from time to time. The version posted on this page at the time you place an order applies to that order. Your continued use of the site or placing of orders after changes are posted constitutes acceptance of the updated Terms.

18. Eligibility

You must be at least 18 years old and able to enter into a binding contract to place an order with us.

19. Electronic Communications

You consent to receive order confirmations, receipts, delivery notices, and other communications relating to your order electronically, by email or text message sent to the contact details you provide. You may withdraw this consent by contacting us, though we may then be unable to accept orders from you online.

20. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
